Terms and Conditions
1. Introduction
Welcome to the Tidy Tiling website. These Terms and Conditions outline the rules and regulations governing the use of this website and the services provided by Steven Bone, a sole trader trading as Tidy Tiling.
By accessing this website and/or instructing Tidy Tiling to carry out works, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use this website or engage Tidy Tiling’s services.
1.1 Definitions and Interpretation
In these Terms and Conditions, the following words and expressions shall have the meanings set out below:
“Client”
The individual, business, landlord, or other party who instructs Tidy Tiling to carry out the Works.
“Contractor”, “we”, “us”, or “our”
Steven Bone, a sole trader trading as Tidy Tiling.
“Tidy Tiling”
The trading name under which the Contractor provides tiling and related services.
“Works”
The tiling works and any additional services expressly agreed to be carried out by Tidy Tiling, as described in the accepted Estimate and/or Invoice.
“Estimate”
A written quotation issued by Tidy Tiling setting out the proposed scope of Works, price, and any applicable terms, whether provided via QuickBooks, email, or other written format.
“Invoice”
A written request for payment issued by Tidy Tiling in respect of the Works carried out or to be carried out.
“Deposit”
An advance payment required to secure a booking and provisional start date, as specified in the Estimate or Invoice.
“Third-Party Trades”
Any contractors, tradespeople, or professionals not engaged by Tidy Tiling, including but not limited to plumbers, electricians, or structural specialists engaged directly by the Client.
“Written” or “In Writing”
Includes email and electronic communications unless expressly stated otherwise.
“Terms”
These Terms and Conditions as amended from time to time in accordance with Section 17.
2. Services Provided
2.1 Tidy Tiling provides professional tiling services as a sole trader, including but not limited to:
Wall and floor tiling using ceramic, porcelain, mosaic, and natural stone materials
Kitchens, bathrooms, wet rooms, waterproofing systems, outdoor areas
General tile repairs, replacements and refurbishment works
2.2 Works may include preparatory and associated tasks reasonably required to complete the agreed tiling works, such as surface preparation, removal of existing finishes, minor remedial works, and coordination with other installed elements, where suitable and agreed.
2.3 Full bathroom renovations and wet room installations are undertaken on a manageable scale appropriate to the size and resources of the business at the time the works are carried out.
2.4 Works will normally be carried out personally by the Contractor. Where necessary and at the Contractor’s discretion, works may also be carried out by employees, apprentices, or subcontractors engaged directly by Tidy Tiling and working under its supervision. In such cases, Tidy Tiling remains responsible for the standard of the works provided.
2.5 Where agreed in advance and expressly stated in the estimate and/or invoice, Tidy Tiling may also undertake limited non-specialist ancillary works (for example, basic non-gas plumbing tasks, minor carpentry such as door hanging, or similar tasks).Where such services fall outside Tidy Tiling’s core specialist trade and are undertaken without holding specific professional certification at the time, the Client accepts this on an informed basis. Gas works and other regulated activities are expressly excluded unless carried out by appropriately certified professionals.
2.6 Tidy Tiling reserves the right to refuse or amend estimates for projects outside its reasonable capabilities or capacity.
3. Third-Party Trades and Liability
3.1 Tidy Tiling is responsible only for the tiling works and any additional services expressly stated as being provided by Tidy Tiling in the accepted estimate and/or invoice, including any agreed non-specialist ancillary works.
3.2 Where third-party trades are required and are not engaged by Tidy Tiling, the Client enters into direct contractual agreements with those parties.
3.3 Tidy Tiling does not accept responsibility or liability for the workmanship, delays, defects, or failures of third-party contractors, nor for any consequential issues arising from their services.
3.4 Where coordination is requested, Tidy Tiling acts solely as a facilitator and not as a principal contractor.
3.5 Clients are responsible for verifying the qualifications, insurance, and guarantees of any third-party trades engaged.
4. Estimates and Quotations
4.1 All estimates are fixed-price offers based on information supplied by the Client and the agreed scope of works at the time of consultation.
4.2 Estimates are valid for 30 days from the date of issue.
4.3 Start dates and timeframes are provisional until the booking is secured.
4.4 To secure a booking and provisional start date, the Client must:
• Accept the estimate via the QuickBooks acceptance link or in writing (including email); and
• Pay any required deposit as specified in the estimate or separate invoice.
Where no deposit is required (for example, small works that can be undertaken promptly or on the day of the estimate), Tidy Tiling will confirm the secured booking and agreed dates in writing (including email).
4.5 A legally binding contract is formed once the estimate is accepted in writing or via the QuickBooks acceptance link.
4.6 Prices are fixed once accepted and may only be adjusted where both parties agree in writing (including email) to a variation of the scope of works, or where genuinely unforeseen site conditions arise that could not reasonably have been identified at the time of estimating. In such circumstances, either party may discuss reasonable options, including revised pricing, amended scope, or termination of the affected part of the works without penalty, in accordance with consumer law.
4.7 Any changes to the scope of works may require a revised estimate and adjusted pricing.
5. Payment Terms
5.1 A deposit may be required as specified in the estimate or deposit invoice. Payment of the deposit secures the booking and provisional start dates (see Section 4).
5.2 The remaining balance is due in full upon completion or practical completion of the works.
5.3 An invoice for the balance will be issued on the final day of the project or upon practical completion.
Payment Methods
Bank Transfer – via QuickBooks payment link or direct bank transfer
Card Payments – via QuickBooks payment link (availability may vary due to the higher processing fees)
Cash – accepted at Tidy Tiling’s reasonable discretion (typically small jobs only)
5.4 All payments must be made without deduction or set-off.
5.5 Late payments may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
6. Cancellations, Rescheduling, and Refunds (Client)
6.1 Where the contract is formed off-premises, Clients have a 14-day cooling-off period under the Consumer Contracts Regulations 2013.
6.2 This period begins the day after the estimate is accepted.
6.3 Cancellation during this period must be provided in writing (including email).
6.4 If no work or material ordering has commenced, all payments (including the deposit) will be refunded within 14 days.
6.5 Where the Client requests work or material ordering during the cooling-off period and provides express consent, cancellation rights may be limited. Reasonable costs incurred up to cancellation may be charged.
6.6 After the cooling-off period, deposits are non-refundable and non-transferable, as they secure allocated time and scheduling commitments.
6.7 Where materials have been purchased specifically for the project and are non-returnable or bespoke, the Client remains liable for their cost.
6.8 Tidy Tiling will make reasonable efforts to mitigate losses and will provide an itemised breakdown of any retained sums in compliance with the Consumer Rights Act 2015.
7. Cancellations or Rescheduling by Tidy Tiling
7.1 Tidy Tiling may reschedule or cancel due to unforeseen circumstances beyond reasonable control, including illness, emergencies, or delays from earlier projects.
7.2 Clients will be notified as soon as reasonably possible.
7.3 Where cancellation occurs, all payments will be refunded, excluding costs already incurred for non-returnable materials purchased with prior consent.
7.4 Tidy Tiling is not liable for indirect or consequential losses, including loss of earnings or inconvenience, to the extent permitted by law.
8. Client Responsibilities
8.1 The Client must provide safe, clear, and uninterrupted access to the property.
8.2 The work area must be cleared of belongings, furniture and fragile items unless agreed otherwise in writing (including email) or stated in the estimate and/or invoice.
8.3 The Client must disclose known issues, including but not limited to:
Structural defects
Damp or water ingress
Asbestos or hazardous materials
Plumbing or electrical faults
8.4 The Client shall ensure that all necessary permissions, consents, and approvals (including landlord or freeholder consent where applicable) are obtained prior to the start of the works.
8.5 Electricity and water must be provided at no additional cost unless agreed in writing (including email).The Client also agrees to provide reasonable access to toilet facilities at the property or work site for the duration of the works, unless stated otherwise in writing.
8.6 Failure to meet these responsibilities may result in delays or additional charges.
9. Warranties and Liability
9.1 All work will be carried out with reasonable care and skill.
9.2 The Contractor is not liable for defects or failures arising from:
Client-supplied materials
Pre-existing defects including structural, plumbing, electrical, or substrate issues
Structural movement, settlement or natural building shrinkage
Previous poor workmanship
9.3 Any advice given does not constitute a structural, engineering, or professional survey.
9.4 The Contractor’s liability is limited to the rectification of defective workmanship directly attributable to Tidy Tiling.
9.5 No liability is accepted for indirect or consequential losses, including loss of use, loss of profit, or alternative accommodation costs.
9.6 Nothing in these Terms excludes or limits liability where it would be unlawful to do so under applicable legislation.
10. Public Liability Insurance
10.1 Tidy Tiling holds appropriate public liability insurance.
10.2 Evidence of insurance is available upon reasonable request.
11. Materials, Ownership, and Risk
11.1 Client-supplied materials remain at the Client’s risk at all times.
11.2 Contractor-supplied materials become the Client’s property upon payment.
11.3 All materials are at the Client’s risk once delivered to site.
12. Complaints and Defects Procedure
12.1 Any concerns must be reported in writing within a reasonable time.
12.2 Tidy Tiling must be given a reasonable opportunity to inspect and rectify issues before third parties are engaged.
13. Intellectual Property Rights
13.1 All designs, drawings, quotations, specifications, photographs, video recordings, and written materials produced by or on behalf of Tidy Tiling remain the intellectual property of Tidy Tiling unless otherwise agreed in writing.
13.2 These materials may not be reproduced, shared, or provided to third parties without prior written consent.
13.3 Tidy Tiling reserves the right to photograph and record video footage of works for use on its website, social media platforms, marketing materials, and YouTube or other video-sharing channels for the purpose of promoting the business.
If the Client does not wish for images or footage of the works to be used in this way, this must be agreed in writing prior to commencement. No personal items or identifying features will be included without consent.
14. Force Majeure
14.1 Tidy Tiling shall not be liable for delays or failures caused by events beyond reasonable control, including extreme weather, supply shortages, or acts of God.
15. Severability
15.1 If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
16. Governing Law
16.1 These Terms are governed by the laws of England and Wales.
16.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Amendments to Terms
17.1 These Terms and Conditions may be updated from time to time.
17.2 Amendments do not apply retrospectively unless required by law.
17.3 The version of the Terms and Conditions in force at the time the estimate is accepted shall apply to the works.
17.4 Previous versions of these Terms and Conditions will be retained and made available upon reasonable request.Clients are advised to retain a copy of the Terms provided or linked at the time of acceptance. Where Terms are accepted via the website or electronic estimate system, records of acceptance and the applicable version will be retained for evidential purposes.
